Acceptance of terms

By accessing or using any website, product, or service operated by Observetech Sdn. Bhd., you agree to these Terms of Use. If you are using the services on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.

Business use only

Our services are intended for business and operational use. They are not offered for personal, consumer, or casual social messaging purposes.

Lawful use only

You may use the services only for lawful purposes and in compliance with applicable laws, regulations, contractual requirements, and third-party platform rules.

Prohibited uses

You must not use the services for any prohibited activity, including:

• Spam or unsolicited bulk messaging.
• Fraud, phishing, impersonation, or deceptive conduct.
• Harassment, abuse, or unlawful targeting of individuals.
• Distribution of unlawful, misleading, or infringing content.
• Uses that violate WhatsApp rules or other third-party platform policies.
• Any conduct that interferes with, misuses, or threatens the integrity of the services.

Client responsibility for message content and permissions

Clients are solely responsible for the content of messages, records, attachments, and other material transmitted through the services. Clients are also responsible for providing notices and obtaining any permissions or consent required before contacting end users.

Account security and authorized users

Clients are responsible for maintaining the confidentiality of account credentials, controlling access by authorized users, and promptly notifying Observetech Sdn. Bhd. of suspected unauthorized access, misuse, or security incidents affecting the services.

Suspension and termination

We may suspend, restrict, or terminate access to the services if we reasonably believe there is a violation of these terms, misuse of the services, a security or legal risk, non-payment where applicable, or a need to protect our systems, clients, users, or third parties.

Service availability disclaimer

We aim to operate reliable services, but availability may be affected by maintenance, infrastructure issues, third-party platform outages, security events, or circumstances outside our control. The services are provided on an as available basis to the extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Observetech Sdn. Bhd. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or relating to the services, even if we have been advised of the possibility of such damages.

Changes to these terms

We may revise these Terms of Use from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of the services after updated terms become effective constitutes acceptance of the revised terms.

Governing law

These Terms of Use are governed by the laws of the applicable jurisdiction specified in the relevant customer agreement or, if no such agreement exists, by a governing law to be determined and specified by Observetech Sdn. Bhd.
